Terms of Service

These Terms of Service ("Terms") govern your access to and use of TrailScout (the "Directory"), operated by CKKC Associates LLC ("we", "us", "our"). By using the Directory or creating an account, you agree to these Terms. If you do not agree, do not use the Directory.

1. Who these Terms apply to

  • Visitors browsing trail listings.
  • Listing Owners — people who claim and manage a listing for an organisation, outfitter, or business.

If you accept these Terms on behalf of a business or organisation, you represent that you are authorised to bind it.

2. Trail information is not safety advice

This is the most important term in this document.

TrailScout describes hiking and off-road trails, including difficulty, vehicle suitability, and seasonal notes. All of it is general information compiled from public and third-party sources, and it may be incomplete, out of date, or wrong.

It is not a safety assessment, a route guarantee, or a substitute for your own judgement. Conditions change with weather, season, fire, washouts, closures, and land-manager decisions, often without notice and faster than any directory can reflect.

Before you travel you are responsible for:

  • checking current conditions, access, permits, and closures with the relevant land manager or agency;
  • assessing whether a route is within your own and your vehicle's capability;
  • carrying appropriate equipment, navigation, recovery gear, and communications.

Backcountry travel and off-road driving carry inherent risks of injury, death, vehicle damage, and becoming stranded. You accept those risks yourself. Do not rely on a difficulty rating, a vehicle-suitability note, or a map on this site as your reason for attempting a route.

Coordinates and maps are approximate and must not be used as your sole means of navigation.

3. Listings and claiming

Listings are compiled from public sources and may be incomplete. A listing does not imply any relationship between us and any business, agency, or land manager.

To claim a listing you must register an account, verify your email address, and submit a claim for our review. We approve claims at our discretion and may require evidence that you are authorised to represent the organisation. Approval lets you edit certain listing fields; it does not transfer ownership of the listing, which remains part of the Directory.

Certain fields — including the listing name, location, and primary image — require our review before changes take effect, to protect the integrity of the Directory and of accumulated reviews and ratings. Other fields update immediately.

We may revoke a claim at any time if we believe it was made without authority or the information is inaccurate.

4. Your content

You retain ownership of text, images, reviews, and other material you submit ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for formatting, and display Your Content in connection with operating and promoting the Directory.

You warrant that:

  • you own Your Content or have all necessary rights to submit it, including for photographs and any people shown in them;
  • it is accurate and not misleading, particularly any statement about trail difficulty, access, legality, or vehicle requirements;
  • it does not infringe anyone's rights and is not unlawful, defamatory, discriminatory, or offensive.

Do not post information encouraging illegal access. That includes routes across private land without permission, closed or decommissioned roads, and travel that breaches land-manager rules. We remove it when we find it.

5. Reviews

Reviews must reflect genuine first-hand experience. Do not post reviews for competitors, for compensation, or on behalf of someone else. We may remove reviews that breach these Terms, and we may remove a listing's reviews if we find them to be manipulated.

Reviews and ratings belong to the Directory record, not to the Listing Owner, and are not transferred or removed on claim.

6. Acceptable use

You must not misuse the Directory, including by scraping it at scale, interfering with its operation, attempting unauthorised access, submitting false claims, or using it to send unsolicited communications.

7. Nothing is for sale here

TrailScout does not currently sell paid placements, subscriptions, or any other product. If that changes we will publish separate purchase terms before anything is offered, and they will apply only to purchases made after they are published.

8. Disclaimers and limitation of liability

The Directory is provided "as is" and "as available". To the fullest extent permitted by law we exclude all implied warranties, including any warranty of accuracy, fitness for a particular purpose, or that any route is safe or passable.

To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with these Terms and the Directory is limited to USD $100, reflecting that the Directory is provided free of charge. We are not liable for lost profits, lost data, property damage, or indirect or consequential loss.

Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded — and nothing in section 2 is intended to exclude such liability.

We are not a party to any transaction between you and any business listed in the Directory, and we do not verify the insurance, licensing, or competence of listed operators.

9. Indemnity

You will indemnify us against any claim, loss, or expense arising from Your Content or from your breach of these Terms.

10. Suspension and termination

You may close your account at any time. We may suspend or terminate your account or a listing for breach of these Terms, or where required by law. Sections 2, 4, 8, and 9 survive termination.

11. Privacy

Our handling of personal data is described in our Privacy Policy.

12. Changes to these Terms

We may update these Terms. Material changes will be reflected in the "last updated" date above.

13. Governing law

These Terms are governed by the laws of the State of California, and the state and federal courts located in Sacramento County, California have exclusive jurisdiction, without prejudice to any mandatory consumer protections available to you where you live.
